● How to Conduct trademark Search
It is important to conduct a search of the trade mark register to see if your trade mark is already registered or has been applied for by another trader. You can conduct your own search online at esearch.ipd.gov.hk

● From application to registration process
1. Application
After filed the application ,we will notify you theapplication number.
2.Deficiencies Checking
Hong Kong Intellectual Property will examine to see if all the necessary parts of the form(s) have been filled in.
If everything is in order your application will proceed to (Search and examination).
If any required information is missing
we will ask you to provide the information to remedy the deficiencies within 2 months from the date of Registry's notice.
3. Search & Examination
Hong Kong Intellectual Property will examine if your application formalities meet all requirements.
4. Objections
If the requirements for registration are not met we will object to the mark.
The applicant have 6 months in which to meet the requirements.
A further 3 months extension may be granted.
5. Hearing
If you call for a hearing, all the evidence for and against the trademark will be considered at a hearing, and a decision will be issued by a hearing officer.
6. Publication for Opposition at the HKIP Journal
Anyone can view your trademark in the Hong Kong Intellectual Property Journal and lodge an opposition to it.
They have to file an opposition notice within the 3-month period beginning on the publication date.
If there are no objections to the trademark, it will be published in the Hong Kong Intellectual Property Journal.
7. Registration
The next step is to see whether anyone wants to oppose your trademark or not.
If there is no opposition, or the opposite result is concluded in favor of your trademark, then the Registrar of Trade Marks will issue a certificate of registration for your trademark.
● Time scale (how long does the process take?)
If there are no deficiencies in the application and no objections to the trade mark then thewhole application procedure can take 6-9 months from receipt of application to registration.
● Fees
Official fee :
(USD 260) HK$2,000 to apply to register a trade mark in one class of goods or services; and(USD 130) HK$1,000 for each additional class of goods or services.
