1.Introduction

Taiwan, officially the Republic of China, is a state in East Asia. Taipei is the political capital as well as economic and cultural centre in Taiwan.

2.What is the summary of Taiwan trademark registration process

After filing the application, the Taiwan IP Office will check if the application can satisfy the formality requirements.

When the examination is completed and the application has been accepted for registration, the Registrar will issue a notification requesting payment of the registration fee.

And if no opposition are filed within 3 months after publication, registration will be granted dated as of the day on which the application was filed

3.Why should we register a Taiwan trademark

Any  corporations and individuals and be it resided in or outside Taiwan, that desires to obtain the exclusive right of a trademark to distinguish its goods and/or services from those of others in Taiwan should apply for its registration with the trademark authority in accordance with the Taiwan Trademark Law.

Registering a trademark, gives you the legal right to it. It gives you exclusive rights to use the trademark in connection with the goods and services you register for and you can stop others from using the same.

4.How to register a Taiwan trademark?

●Madrid international registration or filing  the application directly?

You can only choose to file the Taiwan trademark application directly.

●How to Conduct trademark Search

It is important to conduct a search of the trade mark register to see if your trade mark is already registered or has been applied for by another trader. You can conduct your own search online at https://twtmsearch.tipo.gov.tw/OS0/OS0101.jsp?l6=en_US&isReadBulletinzh_TW=true

●What information are required for Taiwan trademark application?

-Scanned copy of POA

- the applicant's details;

- a list of goods and services;

-mark;

●CAN I FILE A MULTI-CLASS APPLICATION IN TAIWAN?

YES.

●Time scale (how long does the registration process take?)

It takes about 9-12 months from filing to registration if there is no objection from the examiner.

Now, TIPO has launched a fast-track mechanism which, through its  e-filing system, will speed up examination time and is two months faster than the regular track.

②Formality Examination

After filing the application, the Taiwan IP Office will check if the application can satisfy the formality requirements.

③Substantial Examination

The procedures for examining a trademark application differ from a general application filed by the public and are more complicated. In addition to examining the designated goods, a search of the representations of prior registered trademarks and the examination on whether the trademark has any unregistrable conditions must be carried out. 

④Registration Fee

After the examination is completed and the application has been accepted for registration, the Registrar will issue a notification requesting payment of the registration fee.

⑤Registration Publication

The application will be published in the Trademark Gazette for 3 months

⑥Registration

If no opposition are filed within 3 months after publication, registration will be granted dated as of the day on which the application was filed. Then the certificate of trademark registration will be issued.

（USD110）NT$3,000.00 if the designated goods are under 20 items; and

（USD7）NT$200.00 for each additional item if over 20 items.

Services

（USD110） NT$3,000.00; and

（USD20）NT$500.00 for each additional retail service of specific goods if there are over five(5) such services in class 35.

（USD91）NTS2,500.00.
