CNIPA:The average trademark examination period will be shortened to 4 months

    September 6, 2021, the State Intellectual Property Office issued a letter on the response to the proposal No. 4698 (Politics and Law No. 345) of the Fourth Session of the 13th CPPCC National Committee. 


    It is clearly pointed out that “research and establish a cooperative working mechanism between the enterprise registration department and the trademark registration management department”speed up the realization of the synchronization update of the enterprise change data and the trademark change data, and promote the data sharing and system linkage between the enterprise registration system and the trademark registration system. At the same time, it mentioned "research on the structural adjustment of trademark and patent fees to reduce the overall burden of the right holders to maintain intellectual property rights." and "compress the overall authorization cycle of patent examination and trademark registration". The cycle is stable within 4 months, and the trademark registration cycle is generally reduced from 8 months to 7 months."


1.    Study the establishment of a cooperative work mechanism between the enterprise registration department and the trademark registration management department.

    "Promote the simultaneous acceptance of enterprise change registration and trademark change applications, and improve the convenience and immediacy of trademark change." At present, Shanghai, Fuzhou and other places have successively realized the simultaneous acceptance and coordinated processing of enterprise change registration and trademark change applications, speeding up the realization of enterprise changes The data is updated synchronously with the trademark change data.


2. Exploring the implementation of structural fee reductions for trademarks and patents to promote the improvement of application quality

      The "Notice" clearly stated that "to study the structural adjustment of trademark and patent fees with the goal of promoting high-quality development." Under the guidance of the National Development and Reform Commission and the Ministry of Finance, our office will study the structural adjustment of patent and trademark fee standards to reduce the overall burden on rights holders to maintain intellectual property rights. At the same time, we will thoroughly implement the requirements for high-quality development, guide local governments to adjust patent and trademark funding policies, completely abolish funding awards at the application stage, and shift to promoting the effective use of intellectual property rights, strengthening protection, and developing better public services.

 

3.Reduce the overall authorization cycle for patent examination and trademark registration

    The "Notice" clearly stated that "by the end of 2021, the average examination period for trademark registration shall be stabilized within 4 months, and the trademark registration period shall be reduced from 8 months to 7 months in general."

 

    At the same time, the Office will actively promote the revision of the Trademark Law and its implementation regulations, shorten the time for initial trademark review announcements; deepen the use of artificial intelligence, big data and other technologies in the examination work, and promote the establishment of trademark registration and management platforms to improve the quality of examination. And efficiency to provide information support.
